Welcome to Kongu Viswakarma Matrimony (hereinafter referred to as "KVM", "The Platform", "We", or "Us"). This document is an electronic record in terms of the Information Technology Act, 2000, and rules thereunder as applicable and the amended provisions pertaining to electronic records in various statutes as amended by the Information Technology Act, 2000. This electronic record is generated by a computer system and does not require any physical or digital signatures.

1. Introduction and Scope

By accessing, registering, or using the Kongu Viswakarma Matrimony website or mobile application, you agree to be legally bound by these Terms and Conditions ("Agreement"). If you do not agree with these terms, you must not use our services. KVM acts as an "Intermediary" as defined under the Information Technology Act, 2000. We act as a platform to enable users to register and voluntarily search for profiles for matrimonial alliances. We are not a marriage bureau; we are a matchmaking advertising platform.

2. Eligibility Criteria

Membership and rights of admission are reserved solely for:

1. Viswakarma Community Members Only.
2. Indian Nationals and Citizens.
3. Persons of Indian Origin (PIO) or Non-Resident Indians (NRI).

By registering, you represent and warrant that:

• You are at least 18 years of age (if you are a woman) or 21 years of age (if you are a man).
• You are legally competent to marry as per the laws applicable to you.
• You are not prohibited from entering into matrimony by any court order or law.

3. Account Registration and Security

1. Accuracy of Information: You agree to provide true, accurate, current, and complete information about yourself. You must upload recent photographs and accurate details regarding your family, background, and employment.
2. One Profile Per Person: Registration of duplicate profiles for the same person is strictly prohibited. KVM reserves the right to suspend duplicate profiles without notice.
3. Account Security: You are responsible for maintaining the confidentiality of your login credentials. You are fully responsible for all activities that occur under your account.

4. Role and Responsibility of Kongu Viswakarma Matrimony

1. No Guarantees: KVM provides an interface for users to search for prospects. We do not guarantee a successful match or a specific number of responses.
2. Content Verification: While we may screen profiles, KVM cannot verify the complete accuracy of information provided by users. We reproduce profiles on an "as-is" basis.
3. System Generation: Search results are automated based on the preferences set by you.

5. Role and Responsibility of the Member

1. Due Diligence: The responsibility for verifying the authenticity of matches lies entirely with you. You must verify the prospect's background, medical status, financial standing, and character before finalizing any alliance.
2. Caution: You are advised to be cautious of prospects who ask for money, favors, or refuse to involve family members.
3. Notification of Marriage: Upon finalizing a marriage (whether through KVM or other means), you must inform KVM immediately so that your profile can be removed or marked as inactive.

6. Code of Conduct

Users are strictly prohibited from:

• Using the service for any commercial purpose or harassment.
• Posting content that is obscene, defamatory, abusive, or violates the privacy of others.
• Creating fake profiles or impersonating others.
• Engaging in financial transactions with other members.

7. Fees and Payments

1. Membership Packages: Access to contact details and premium features requires a paid membership.
2. Non-Refundable: All payments made to Kongu Viswakarma Matrimony are final and non-refundable. We do not offer refunds for unused services or if you find a partner shortly after payment.
3. Non-Transferable: Memberships cannot be transferred to another person or assigned to a third party.

8. Limitation of Liability

1. "As Is" Service: To the fullest extent permitted by law, KVM disclaims all warranties, express or implied. We are not liable for any errors, interruptions, or technical malfunctions.
2. No Liability for Interactions: KVM is not responsible for the conduct of any user. We are not liable for any emotional distress, financial loss, or damages resulting from interactions with other members.
3. Third-Party Links: Our platform may contain links to third-party websites. We are not responsible for the content or practices of those sites.

9. Termination

KVM reserves the right to terminate your membership and suspend your access to the service immediately, without notice and without refund, if:

• You breach these Terms and Conditions.
• You provide false or misleading information.
• We receive complaints regarding your conduct from other members.

10. Privacy and Communication

By registering, you consent to receive communications (via SMS, Email, Phone Call, or WhatsApp) from KVM regarding your profile, potential matches, and service updates, even if you are registered with the National Do Not Disturb (DND) registry. 11. Jurisdiction and Dispute Resolution

1. Governing Law: This Agreement shall be governed by the laws of India.
2. Exclusive Jurisdiction: Any disputes arising out of or related to these terms shall be subject to the exclusive jurisdiction of the courts situated in Erode, Tamil Nadu.

கொங்கு விஸ்வகர்மா மேட்ரிமோனிக்கு வரவேற்கிறோம் (இனி "KVM", "தளம்", "நாங்கள்" அல்லது "எங்கள்" என்று குறிப்பிடப்படும்). இந்த ஆவணம் தகவல் தொழில்நுட்பச் சட்டம், 2000 இன் கீழ் ஒரு மின்னணுப் பதிவாகும் (Electronic Record). இதற்கு கையொப்பம் தேவையில்லை.

1. அறிமுகம் மற்றும் நோக்கம்

எங்கள் இணையதளம் அல்லது செயலியைப் பயன்படுத்துவதன் மூலம், இந்த விதிமுறைகள் மற்றும் நிபந்தனைகளுக்கு ("ஒப்பந்தம்") சட்டப்பூர்வமாக கட்டுப்படுவதாக ஒப்புக்கொள்கிறீர்கள். இந்த நிபந்தனைகளை நீங்கள் ஏற்கவில்லை என்றால், எங்கள் சேவைகளைப் பயன்படுத்த வேண்டாம். KVM தகவல் தொழில்நுட்பச் சட்டத்தின் கீழ் ஒரு "இடைத்தரகர்" (Intermediary) ஆக செயல்படுகிறது. திருமண வரன்களைத் தேடுவதற்காகப் பயனர்கள் பதிவு செய்யவும் தேடவும் நாங்கள் ஒரு தளத்தை மட்டுமே வழங்குகிறோம். நாங்கள் திருமணத் தரகர் அல்ல; நாங்கள் வரன்களை இணைக்கும் ஒரு விளம்பரத் தளம் மட்டுமே.

2. தகுதி வரம்புகள்

உறுப்பினர் சேர்க்கை இவர்களுக்கு மட்டுமே வழங்கப்படும்:

1. விஸ்வகர்மா சமூகத்தினர் மட்டும்.
2. இந்தியக் குடிமக்கள்.
3. இந்திய வம்சாவளியினர் (PIO) அல்லது வெளிநாடு வாழ் இந்தியர்கள் (NRI).

பதிவு செய்வதன் மூலம், பின்வருவனவற்றை உறுதிப்படுத்துகிறீர்கள்:

• நீங்கள் பெண்ணாக இருந்தால் 18 வயது அல்லது ஆணாக இருந்தால் 21 வயது பூர்த்தியடைந்திருக்க வேண்டும்.
• சட்டப்படி திருமணம் செய்து கொள்ள உங்களுக்குத் தகுதி உண்டு.
• நீதிமன்ற உத்தரவு அல்லது சட்டத்தின் மூலம் நீங்கள் திருமணம் செய்து கொள்ளத் தடை எதுவும் இல்லை.

3. கணக்கு பதிவு மற்றும் பாதுகாப்பு

1. தகவலின் துல்லியம்: உங்களைப் பற்றிய உண்மையான மற்றும் முழுமையான தகவல்களை வழங்க ஒப்புக்கொள்கிறீர்கள். சமீபத்திய புகைப்படங்கள் மற்றும் குடும்பம், வேலை தொடர்பான சரியான விவரங்களைப் பதிவேற்ற வேண்டும்.
2. ஒருவருக்கு ஒரு கணக்கு: ஒரே நபருக்கு இரண்டு கணக்குகள் தொடங்குவது தடைசெய்யப்பட்டுள்ளது. அவ்வாறு கண்டறியப்பட்டால் முன்னறிவிப்பின்றி கணக்கை முடக்க எங்களுக்கு உரிமை உண்டு.
3. கணக்கு பாதுகாப்பு: உங்கள் பயனர் பெயர் (User ID) மற்றும் கடவுச்சொல் (Password) ஆகியவற்றின் பாதுகாப்பிற்கு நீங்களே முழுப் பொறுப்பு.

4. கொங்கு விஸ்வகர்மா மேட்ரிமோனியின் பங்கு

1. உத்தரவாதம் இல்லை: வரன்களைத் தேடுவதற்கான இடைமுகத்தை (Interface) மட்டுமே நாங்கள் வழங்குகிறோம். திருமணம் நிச்சயிக்கப்படுவதற்கோ அல்லது குறிப்பிட்ட எண்ணிக்கையிலான வரன்கள் கிடைப்பதற்கோ நாங்கள் உத்தரவாதம் அளிக்க மாட்டோம்.
2. தகவல் சரிபார்ப்பு: பயனர்கள் வழங்கும் தகவல்களின் முழுமையான துல்லியத்தை எங்களால் சரிபார்க்க இயலாது. பயனர்கள் வழங்கிய விவரங்களை அப்படியே வெளியிடுகிறோம்.
3. கணினி உருவாக்கம்: நீங்கள் அமைக்கும் விருப்பத்தேர்வுகளின் அடிப்படையில் தேடல் முடிவுகள் தானியங்கிப்படுத்தப்படுகின்றன.

5. உறுப்பினரின் பொறுப்புகள்

1. சரிபார்த்தல்: வரன்களின் பின்னணி, மருத்துவ நிலை, மற்றும் குணநலன்களைச் சரிபார்ப்பது முழுக்க முழுக்க உங்கள் பொறுப்பு. திருமணம் முடிப்பதற்கு முன் தீர விசாரித்துக்கொள்ளவும்.
2. எச்சரிக்கை: பணம் கேட்கும் நபர்களிடமோ அல்லது குடும்பத்தினரை ஈடுபடுத்த மறுக்கும் நபர்களிடமோ கவனமாக இருக்கவும்.
3. திருமணத் தகவல்: திருமணம் நிச்சயிக்கப்பட்டவுடன் (எங்கள் தளம் மூலமாகவோ அல்லது வேறு வகையிலோ), உடனடியாக மையத்திற்குத் தகவல் தெரிவிக்க வேண்டும்.

6. நடத்தை விதிகள்

பயனர்கள் பின்வருவனவற்றைச் செய்யக் கூடாது:

• சேவையை வணிக நோக்கத்திற்காகப் பயன்படுத்துதல்.
• ஆபாசமான அல்லது பிறர் மனதைப் புண்படுத்தும் தகவல்களைப் பதிவிடுதல்.
• போலி கணக்குகளை உருவாக்குதல்.
• மற்ற உறுப்பினர்களுடன் பணப் பரிவர்த்தனையில் ஈடுபடுதல்.

7. கட்டணம் மற்றும் பணம் திரும்பப் பெறுதல்

1. உறுப்பினர் தொகுப்புகள்: தொடர்பு விவரங்கள் (Contact Details) மற்றும் கூடுதல் சேவைகளைப் பெற கட்டணம் செலுத்த வேண்டும்.
2. பணம் திரும்பப் பெறப்படாது (Non-Refundable): செலுத்திய கட்டணம் எக்காரணம் கொண்டும் திருப்பித் தரப்பட மாட்டாது. கட்டணம் செலுத்திய சிறிது காலத்திலேயே உங்களுக்குத் திருமணம் நிச்சயமானாலும் பணம் திரும்பக் கிடைக்காது.
3. மாற்றத்தக்கதல்ல: உங்கள் உறுப்பினர்த் திட்டத்தை வேறொருவருக்கு மாற்ற முடியாது.

8. பொறுப்புத் துறப்பு

1. "As Is" சேவை: சட்டத்தால் அனுமதிக்கப்பட்ட முழு அளவில், KVM அனைத்து வெளிப்படுத்தப்பட்ட அல்லது மறைமுக உத்தரவாதங்களையும் மறுக்கிறது. எந்தவொரு தொழில்நுட்ப குறைபாடுகள், சேவை தடை அல்லது பிழைகளுக்கும் KVM பொறுப்பல்ல.
2. தொடர்புகளுக்கான பொறுப்பு இல்லை: எந்த பயனரின் நடத்தை குறித்தும் KVM பொறுப்பல்ல. பிற உறுப்பினர்களுடன் ஏற்பட்ட தொடர்புகளால் உண்டாகும் மன உளைச்சல், நிதி இழப்பு அல்லது சேதங்களுக்கு KVM பொறுப்பேற்காது.
3. மூன்றாம் தரப்பு இணைப்புகள்: எங்கள் தளம் மூன்றாம் தரப்பு இணையதளங்களுக்கான இணைப்புகளை கொண்டிருக்கலாம். அந்த இணையதளங்களின் உள்ளடக்கம் அல்லது நடைமுறைகளுக்கு KVM பொறுப்பல்ல.

9. கணக்கு நீக்கம்

பின்வரும் காரணங்களுக்காக முன்னறிவிப்பின்றி உங்கள் கணக்கை நீக்க எங்களுக்கு உரிமை உண்டு:

• விதிமுறைகளை மீறினால்.
• தவறான தகவல்களை வழங்கினால்.
• உங்கள் மீது புகார்கள் வந்தால்.

10. தகவல் தொடர்பு

பதிவு செய்வதன் மூலம், SMS, மின்னஞ்சல் அல்லது வாட்ஸ்அப் (WhatsApp) வழியாகத் தொடர்பு கொள்ள ஒப்புக்கொள்கிறீர்கள். மேலும் அறிய எங்கள் தனியுரிமைக் கொள்கை & குழந்தை பாதுகாப்பு தரநிலைகளைப் பார்வையிடவும்.

11. அதிகார வரம்பு

1. பொருந்தும் சட்டம்: இந்த ஒப்பந்தம் இந்திய சட்டங்களின்படி கட்டுப்படுத்தப்படும்.
2. தனிப்பட்ட நீதிமன்ற அதிகாரம்: இவ்விதிமுறைகளுடன் தொடர்புடைய அல்லது அதிலிருந்து உருவாகும் அனைத்து விவாதங்களும் தமிழ்நாடு மாநிலம், ஈரோடு நகரில் அமைந்துள்ள நீதிமன்றங்களின் தனிப்பட்ட அதிகாரத்திற்கு உட்பட்டவை.
